Abstract: Issues like over stress on confidentiality,ignorance of declassification and lagging of declassification are major obstacles restricting the transfer of national defense patents to the civil do-main.This paper,based on the analysis on realistic necessity of reconstruction of the national defense patent declassification mechanism,combined with the national defense patent system,systematically designs a national defense patent declassification mechanism from aspects like establishment of a se-cret committee,principles and process,which features annual dynamic declassification,compulsory declassification and active declassification application.Furthermore,it suggests supporting measures in the respects like determination of declassification responsibilities of National Defense Intellectual Property Agency,division of liability for disclosing confidentiality without authorization and the building of technology transfer intermediary service system.
