Abstract: With the rapid development of computer and information technology, network has become indispensable to modern society of information and communication tool, but also the use of computer network implementation of fraud, theft, gambling, obscene articles, infringement of intellectual property rights and many other crimes also presents the fast rising trend. By E-mail, and chat online electronic data records exist, Webpage, domain name and other electromagnetic record form, as the core and foundation of network crime of criminal procedure, the value orientation in relation to the entity with the program of this kind of crime justice, crime control and human rights protection, conlfict of interest and between the state power and civil rights balance and the purpose of criminal proceedings. But at present our country electronic evidence has many problems, urgently needs to be standardized.
