Abstract: 由于新修订的《劳动合同法》和《劳务派遣暂行规定》对劳务派遣进行了较为严格的限制,一些用工和派遣企业转而试图套用“外包”的概念来规避相关法律,以合法掩盖非法,从而导致了一些潜在的社会矛盾和企业用工问题.同时,也使执法监督陷入“假外包、真派遣”的界定和甄别困境中.如何才能走出困境?关键在于正确认识人力资源服务业中劳务承揽与劳务派遣的异同之处,以免劳务承揽在甄别“假外包、真派遣”的执法中被“误伤”.
