Abstract: 名人有进行广告代言并从中获取经济利益的权利。同时,名人在广告代言的过程中也承担诸如不得进行虚假陈述和应尽注意的义务。我国现有立法对于名人代言广告行为的法律责任的规定处于缺位状态,应尽快借鉴美国等国家的相关立法进行完善。
